Marriage Based Green

Issued to a spouse of a US citizens or permanent legal resident who legally married and is able to demonstrate that they are romantically involved ( this of course is open for interpretation)

  • This type of visa allows the holder to reside in the United States with the ability to work and have access to resources. If granted prior to 2 years of marriage, the applicant will be granted temporary residence (known as a probationary period). After completing the two year period the applicant is able to apply for an adjustment of status/ Form I-751, Petition to Remove Conditions on Residence, to obtain a permanent green card which is issued for a period of 10 years. The holder is then in a position after lawfully continuously living in the US and if there is no deficiencies to their ability to prove good conduct and the applicant meets the criteria’s to qualify, may apply for US citizenship.

Joe Bidens Undocumented Spouse – Executive Order

The Joe Bidens Administration has announce the new approach to protect spouses of US citizens who have been married for a minimum of 10 years prior to June 17,2024. The order is designed to allow legally married spouse who are continuously present in the United States undocumented to find an easier way to obtaining their legal status, obtaining employment authorization, and protection from deportation. It is also aimed to reducing the wait time to be legitimately documented.

The applications for this service are not yet being accepted by USCIS , however, Bri’Jerton IAS is currently preparing applicants to avoid the last minute rush and be caught up in the possible backlog.
